INTELLECTUAL PROPERTY POLICY
OWNERSHIP, LICENSING & INTERNATIONAL PROTECTION FRAMEWORK
This Intellectual Property Policy governs all proprietary rights, user-generated content, and licensing relationships within the MelanationProject Private Membership Association (“Association”), operated under a Private Trust (“Trust”).
1. Trust Ownership of Platform Assets
All platform assets, including but not limited to:
- Source code, software architecture, and algorithms
- Designs, user interfaces, and visual systems
- Avatars, character systems, and digital representations
- Databases, schemas, and system frameworks
- Branding, trademarks, logos, and proprietary identifiers
- AI models, outputs, and system-generated content
are the exclusive property of the MelanationProject Trust.
These assets are protected under applicable intellectual property laws, including international copyright, trademark, and trade secret protections.
2. International Protection Alignment
The Trust asserts and maintains its intellectual property rights in alignment with internationally recognized frameworks, including but not limited to:
- The Berne Convention for the Protection of Literary and Artistic Works
- The TRIPS Agreement (WTO)
- World Intellectual Property Organization (WIPO) standards
Protection is enforced to the maximum extent permitted under applicable law across all jurisdictions in which the platform operates.
3. User-Generated Content Ownership
Members retain ownership of original content they create and upload to the platform (“User Content”), subject to the terms of this Agreement.
User Content must:
- Be original or properly licensed by the Member
- Not infringe upon third-party rights
- Comply with all Association policies
Members bear full responsibility for the legality and ownership of their content.
4. License Grant to the Association
By submitting, uploading, or creating content within the platform, Members grant the Association and Trust a:
- Worldwide
- Non-exclusive
- Royalty-free
- Perpetual (for the duration of membership and archival purposes)
- Transferable and sublicensable
license to:
- Use, reproduce, display, perform, and distribute User Content
- Modify, adapt, and integrate content into platform systems
- Utilize content for platform operation, improvement, promotion, and ecosystem development
This license exists solely for the operation and advancement of the Association and does not transfer ownership of User Content.
5. Derivative Works & System Integration
Where User Content is integrated into platform systems, including but not limited to:
- Avatar systems
- AI training or personalization models
- Gamification and reward systems
- Community features
the resulting derivative works, system outputs, and enhancements are owned by the Trust, while the underlying User Content remains owned by the Member.
6. Limited Use by Members
Members are granted a limited, revocable, non-transferable license to access and use platform assets solely for personal use within the Association.
Members may not:
- Copy, reproduce, or distribute platform assets outside the ecosystem
- Reverse engineer, decompile, or exploit system components
- Use platform IP for commercial purposes without express written authorization
7. Trademark & Brand Protection
All names, logos, marks, and brand identifiers associated with MelanationProject and the Human Modding ecosystem are protected trademarks or proprietary identifiers.
Unauthorized use, reproduction, or misrepresentation of these marks is strictly prohibited.
8. Infringement & Enforcement
The Association and Trust reserve the right to:
- Remove or restrict access to infringing content
- Suspend or terminate membership for violations
- Pursue legal or equitable remedies where applicable
Members who believe their intellectual property rights have been violated may submit a formal notice through designated channels.
9. Cross-Border Enforcement Limitations
Members acknowledge that intellectual property rights and enforcement mechanisms vary by jurisdiction.
While the Trust asserts its rights globally, enforcement is subject to:
- Applicable national laws
- Jurisdictional limitations
- International enforcement mechanisms
10. Reservation of Rights
All rights not expressly granted herein are reserved by the Trust.
Nothing in this Agreement shall be interpreted as granting ownership, equity, or proprietary interest in the platform or its assets to any Member.
11. Acknowledgment
By participating in the Association, Members acknowledge and agree to:
- Respect all intellectual property rights
- Comply with this policy and all applicable laws
- Grant the licenses described herein
Failure to comply may result in immediate enforcement action.
