TERMS OF SERVICE
PRIVATE MEMBERSHIP USE, PLATFORM GOVERNANCE & INTERNATIONAL COMPLIANCE

These Terms of Service (“Terms”) govern access to and use of the Human Modding platform, operated by the MelanationProject Private Membership Association (“Association”) and administered under a Private Trust (“Trust”).

By accessing, registering, or using the platform, you (“Member”) agree to be bound by these Terms and all related governing documents of the Association.

1. Private Membership Framework

The platform operates exclusively as a private membership environment.

  • Access is restricted to consenting Members
  • All participation is governed by private contractual agreement
  • The platform is not a public service, marketplace, or open-access forum

Membership is conditional, revocable, and subject to ongoing compliance.

2. Acceptance of Terms

By using the platform, Members:

  • Acknowledge that they have read and understood these Terms
  • Agree to comply with all policies, systems, and operational rules
  • Accept that continued use constitutes ongoing agreement to updates

If you do not agree, you must discontinue use immediately.

3. Permitted Use

Members are granted a limited, non-exclusive, revocable license to access and use the platform solely for personal use within the Association.

Use must align with:

  • Lawful conduct
  • Association objectives
  • Platform integrity standards

4. Prohibited Conduct

Members agree not to:

  • Abuse, disrupt, or interfere with platform systems
  • Manipulate XP, rewards, progression systems, or data flows
  • Upload, transmit, or distribute unlawful, harmful, or infringing content
  • Reverse engineer, decompile, or exploit platform technologies
  • Attempt unauthorized access to systems, accounts, or data
  • Circumvent security, rate limits, or access controls
  • Use the platform for fraudulent, deceptive, or illegal purposes

5. Platform Governance & Control

The Association retains full authority to:

  • Modify, suspend, or discontinue any feature or functionality
  • Adjust progression systems, rewards, or access tiers
  • Enforce rules, restrictions, and system limitations
  • Maintain operational control over the platform environment

Changes may occur without prior notice where necessary for system integrity or compliance.

6. Membership Enforcement

The Association may, at its sole discretion:

  • Issue warnings or corrective actions
  • Temporarily suspend access
  • Permanently terminate membership
  • Remove or restrict content, assets, or privileges

Enforcement actions are taken to preserve system integrity, security, and community standards.

7. Digital Assets & System Ownership

All platform elements, including but not limited to:

  • XP, rewards, badges, and progression systems
  • Avatars, items, and digital representations
  • Features, tools, and platform content

remain the property of the Trust unless explicitly transferred in writing.

Members do not acquire ownership rights through use or participation.

8. International Compliance & Limitations

Members acknowledge that:

  • Laws and regulations vary by jurisdiction
  • Certain features may be restricted based on location
  • The Association may limit access to ensure legal compliance

Nothing in these Terms is intended to override mandatory legal protections applicable to Members.

9. Disclaimers

The platform is provided on an “as is” and “as available” basis.

The Association makes no guarantees regarding:

  • Availability, reliability, or uninterrupted access
  • Accuracy or completeness of content
  • Outcomes resulting from platform use

Use of the platform is at the Member’s own risk.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Association and Trust shall not be liable for indirect, incidental, or consequential damages
  • Liability is limited to the minimum extent required by law
  • No liability is assumed for events beyond reasonable control

11. Indemnification

Members agree to indemnify and hold harmless the Association and Trust from any claims, damages, or liabilities arising from:

  • Their use of the platform
  • Their violation of these Terms
  • Their infringement of any rights or laws

12. Dispute Resolution

All disputes arising from platform use shall be resolved through private, binding arbitration as defined in the Membership Agreement.

Members waive the right to participate in class actions or public court proceedings, except where prohibited by applicable law.

13. Modifications to Terms

The Association reserves the right to update or modify these Terms at any time.

Continued use of the platform constitutes acceptance of any updated Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with all related Association policies and agreements, constitute the full agreement between the Member and the Association.

16. Acknowledgment

By accessing or using the platform, Members acknowledge and agree that:

  • They are participating within a private membership structure
  • They accept all rules, limitations, and governance controls
  • Their access is conditional and subject to enforcement

Use of the platform constitutes full and binding acceptance of these Terms.

TERMS OF SERVICE

By accessing the Human Modding platform, you agree to comply with all rules, systems, and structures established by the MelanationProject PMA.

You agree not to:

  • Abuse platform systems
  • Manipulate XP, rewards, or progression
  • Upload harmful or illegal content
  • Reverse engineer or exploit the platform

The platform reserves the right to:

  • Modify features without notice
  • Suspend or terminate accounts
  • Restrict access based on tier or behavior

All digital assets, rewards, and features remain the property of the Association unless explicitly transferred.
